Webulant provides Internet Web Site Hosting, Marketing, Development, and Maintenance services. This document contains the complete Terms, Conditions and Guarantees that govern your subscription to Webulant services. By subscribing and using Webulant services you acknowledge that you have read and agreed to this Agreement and all policies posted on the Webulant web site. Webulant may at any time modify the Terms and Conditions. It is your responsibility to review from time to time and stay familiar with these Terms and Conditions. Your continuing use of the services constitutes your acceptance of the Terms and Conditions as modified.

APPROPRIATE USE OF THE SERVICES

CONTENT OF DATA: Webulant reserves the right to refuse to post any information it considers obscene or morally unsuitable, or is seen to breach copyrights, libelous, defamatory or illegal. Should such a submission occur, the customer will be advised which information was deemed unsuitable, and requested to amend the information. If the customer can show a good reason to use the "unsuitable" information its inclusion may be considered.

WEB HOSTING WITHIN YOUR MAINTENANCE PLAN: If you use web hosting services provided by Webulant within your Web Site Maintenance plan, these services are completely governed by Webulant's Web Hosting Terms, Conditions and Guarantees.

ERRORS AND OMISSIONS

Despite the best efforts of Webulant, errors in web page information may occur. At no time will Webulant's responsibility for accidentally including erroneous information extend beyond correcting the error. If a customer discovers an error on their web site, Webulant will immediately correct the error as soon as we are notified. No charge will be levied for correction of errors made by Webulant.  Errors created by the Client will be fixed by Webulant at the hourly rate established in our service agreement.  Webulant cannot be held liable for any loss or damage resulting from an error.

PAYMENTS

All Webulant maintenance plans are monthly accounts and are prepaid. The billing cycle runs from the day of subscription to the same day of the following month. Charges for terminated accounts are not prorated. Webulant reserves the right to change prices at any time, unless other terms have been agreed. The default payment method is credit card (VISA or MasterCard) or business check.  Contact us to request specific instructions.

By the fifth day of each month, Webulant will deliver by e-mail to the Customer a invoice for each month's services.  The Customer shall settle the invoice within 10 business days after receipt. Should there be any problems with the Labor Report relating to the invoice, the parties therein shall resolve them within five business days after receipt of the invoice.  If during this time period there is no problem communicated by the Customer, the invoice is considered accepted.

Each party shall pay its own transaction fees associated with the payment method. Each party shall be responsible for paying all applicable federal, provincial, state and local taxes in relation to the payment.

Payments are possible in almost any currency. If you prefer to make payments in your local currency (not U.S. dollars) please contact us for additional information.

THE PROCESS

Once you sign up for maintenance, and after your setup fee and first month's payment is received, we will review your web site and provide our initial report on suggested improvements to be made within five business days. Once the requested work is done, all results will be reported to the Customer. Monthly time allowance included in each maintenance plan is not cumulative.

COPYRIGHT

The changes made are the sole property of the Customer once payment has been made in full.

CANCELLATION

Cancellation requests for Webulant accounts must be received in writing via fax or postal service at Webulant's main office one month prior to the next billing cycle. The difficulties in verifying the authorship of email makes it unsatisfactory for transmitting account cancellation requests.

All fees paid in advance of cancellation will be pro-rated and paid back by Webulant. If an account is cancelled by Webulant due to inappropriate use, no fees will be refunded. Any violation of Terms and Conditions that results in extra costs will be billed to the customer.

MONEY BACK GUARANTEE

All of Webulant's maintenance plans are backed by a 30-day money back guarantee. If you are not completely satisfied with our services within the first 30 days of your contract, you will be given a full refund of the contract amount excluding setup fees, domain registration fees, add-on/upgrade fees, overages and US $4 payment processing fee. Setup fees are refundable only if the account is canceled prior to account activation. To cancel an account and get a refund you have to notify Webulant by mail or fax within the first 30 days following activation. No refund is available after the 30th day.

PRICE FREEZE GUARANTEE

All prices are guaranteed for the term of pre-payment. Additionally, for continuous customers in good financial standing, Webulant guarantees that your current maintenance plan pricing is locked forever. If your hosting plan is being upgraded with new features, you will get them for free even if prices for new customers have changed.

PRIVACY GUARANTEE

Webulant will not share or disclose information regarding its Customers except in the event of a legal request, such as a court order, when reasonably necessary to protect the company's rights or property, or in emergencies where someone's safety is at risk.

INDEMNIFICATION

CUSTOMER AGREES TO INDEMNIFY WEBULANT AND ITS OFFICERS, EMPLOYEES, SUPPLIERS, PARTNERS, AND CUSTOMERS AGAINST ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATTORNEY'S FEES, ARISING OUT OF OR RELATING TO YOUR USE OF WEBULANT SERVICES. IN NO EVENT SHALL WEBULANT'S MAXIMUM LIABILITY EXCEED $100.00 (ONE HUNDRED) UNITED STATES DOLLARS.

DISCLAIMER

WEBULANT WILL NOT BE RESPONSIBLE FOR ANY DAMAGES THE CUSTOMER'S BUSINESS MAY SUFFER. WEBULANT MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, FOR SERVICES WEBULANT PROVIDES. WEBULANT DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY WEBULANT AND ITS EMPLOYEES.

The laws of the State of Georgia will govern these Terms and Conditions and any dispute arising hereunder. The exclusive jurisdiction for any dispute shall be the courts located in Atlanta, Georgia.
